Terms of Use

These terms are an agreement between you and AI Daily Dose LLC, a New York limited liability company ("we", "us"), for the PostBud app and service ("PostBud"). By using PostBud you agree to them. If you do not agree, do not use PostBud.

1. Who can use PostBud

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher). If you are under 18, you need your parent or guardian's permission to use PostBud and to buy a subscription, and they agree to these terms for you.

2. Your account

You sign in with Apple. You are responsible for what happens under your account. One person per account. The free plan is limited to one allowance per person and per device; do not create accounts to get around plan limits.

3. Your content

Your clips, voiceovers and videos are yours. To run PostBud you give us a worldwide, non-exclusive, royalty-free license to host, copy, process, transcribe and analyze the content you upload, and to let the service providers named in our Privacy Policy do so for us, only to provide, secure and improve the service for you. The license ends when you delete the content or your account, except for backups and records the law requires us to keep.

You promise that you have the rights to everything you upload, including the right to film and use the people, music, brands and places in it, and that your content and your use of PostBud follow the law and these terms.

4. What you may not do

• Upload content that is illegal, that sexualizes minors, that was filmed or shared without a needed consent, or that infringes someone's rights.
• Use PostBud to harass, deceive, defame or impersonate anyone.
• Break, overload, probe or reverse engineer the service, get around its limits or security, or use it through anything other than the app.
• Resell the service or use it to build a competing product.

We may remove content or suspend or end an account that breaks these terms or puts others or the service at risk.

5. How PostBud works, and its limits

PostBud uses automated systems, including third-party AI services, to transcribe speech, choose a cut and write captions. Results can be wrong: captions may contain errors and a cut may leave out or include the wrong things. Review your video before you post it. You are responsible for what you publish.

PostBud builds the finished video on your device from the originals in your Photos library. If an original is deleted or unavailable, the video cannot be built. We do not store your finished videos; keep your own copies.

On the free plan, videos include a short "made with PostBud" tag.

6. Plans, subscriptions and billing

• PostBud has a free plan and paid plans (Standard and Plus), billed monthly or yearly through your Apple account. Each plan includes a number of videos per month and limits on how much footage can be processed; the app shows the current numbers before you buy. Unused videos do not carry over.
• Subscriptions renew automatically at the then-current price for the same period unless you cancel at least 24 hours before the period ends. Apple charges your Apple account at confirmation of purchase and at each renewal.
• Manage or cancel in your Apple account settings (Settings, your name, Subscriptions). Deleting the app or your PostBud account does not cancel a subscription.
• Payments are handled by Apple and refunds are decided by Apple under its policies. Where the law gives you a right to withdraw or to a refund that cannot be waived, you keep it.
• We may change prices or what a plan includes. A price change for an existing subscription takes effect only as Apple's rules and the law allow, with notice.
• Fair use: plans are for one person making their own videos. We may limit use that is automated, abusive, or far outside normal personal or creator use.

7. Our rights

PostBud, its software, design, name and the Bud character belong to AI Daily Dose LLC. We give you a personal, non-transferable, revocable license to use the app under these terms and Apple's rules. Feedback you send us may be used without obligation to you.

8. Changes and availability

We may change, suspend or end features, and we may require app updates. We try to keep PostBud available but do not promise it will be uninterrupted or error free.

9. Ending

You can stop at any time and delete your account in the app. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering PostBud. Sections that by their nature should survive (content promises, disclaimers, limits of liability, disputes) survive.

10. Disclaimers

PostBud is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that results will be accurate, that your videos will perform in any way on any platform, or that content will never be lost.

11. Limit of liability

To the fullest extent the law allows, AI Daily Dose LLC and its members, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim about PostBud is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Nothing in these terms limits liability that cannot be limited by law, or the rights you have as a consumer under the mandatory laws of the country where you live.

12. Indemnity

If someone brings a claim against us because of your content or because you broke these terms or the law, you will cover our reasonable losses and costs from that claim, to the extent the law allows.

13. Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Disputes will be brought in the state or federal courts located in New York, and you and we consent to those courts. If you are a consumer living outside the United States, you also keep the protection of the mandatory laws of your country and may bring a claim in its courts. Before filing anything, please email us and give us 30 days to try to fix the problem.

14. Apple

These terms are between you and AI Daily Dose LLC, not Apple. Apple is not responsible for PostBud or its content, has no obligation to provide maintenance or support, and is not responsible for any claims about PostBud, including product liability, legal compliance or intellectual property claims. If PostBud fails to meet a warranty that applies, you may notify Apple for a refund of the purchase price, and Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You confirm that you are not in a country under a U.S. government embargo and are not on a U.S. list of prohibited or restricted parties. Your use must also follow the App Store terms.

15. General

If part of these terms is found unenforceable, the rest stays in effect. Not enforcing a term is not a waiver. You may not transfer these terms; we may transfer them with the service. These terms and the Privacy Policy are the whole agreement about PostBud. If we change these terms in a way that matters, we will tell you in the app; using PostBud after the change means you accept it.
